Terms of Business
It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by the photographer/studio in writing.
Booking fee: The photography/creation fee is payable when the client signs the contract, which is one third of the total coverage booked. The fee secures the time and services of the photographer/studio for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Cancellation less than 12 weeks before the wedding will result in payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer/studio can reschedule for the new date and time.
Payments: A further one-third of the wedding/booking fee is due to be paid six months before the wedding date and the remaining balance one month before the wedding date. Please note the wedding preview album will not be released without the final payment. Payment for all reorders must be paid for in full at the time of ordering. All wedding prices include VAT at the current rate. The preview album must be returned to the photographer/studio within 30 days of collection. The client may order finished photographs which are available in a variety of sizes. The client may order as many photographs for their album as they require, above the set number stated in the wedding coverage leaflet for the wedding coverage booked, at extra cost as to our current pricelist. N.B. Any increase in Government Taxes/VAT will be passed on to the client in full.
Display: I/we the client hereby agree to allow the photographer/studio to display any photographs included in this contract in his/her studio, portfolio, display areas, exhibitions, competitions or slide shows.
Photographs: All photograph sizes are nominal. The photographer/studio will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man made fibres. It is sometimes impossible to record on film the exact colour of materials as seen by the human eye, therefore all colour balances are based on flesh tones and purely perceptional.
Retouching: Any retouching and art finishing is available as an optional extra and will be charged at cost.
Copyright: The 1988 Copyright Design and Patents Act section 77 & 80 assigns the copyright of the photographs taken to the photographer/studio. It is contrary to the Act and an offence to copy or allow to be copied, the photographs covered by this contract by any means. DO NOT remove the security tag or screws from the preview album. To do so is a breach of copyright and may lead to prosecution.
Licence: The photographer/studio shall be granted an artistic licence in relation to the poses photographed and the locations used. The photographers/studio judgement shall be deemed as correct in relation to pose and location used.
Force Majeure: The due performance of this contract is subject to alteration or cancellation by the photographer owing to any cause beyond his control. In the unlikely event of total failure or cancellation of the contract by the photographer/studio, liability shall be limited to a refund of all monies paid excluding Government Taxes/VAT.
Negatives: The negatives, previews/transviews remain the property of the photographer/studio. Negatives are kept on an active file for a period of six months after which time a search fee will be made in addition to the prices in force at the time. The photographer/studio agrees to keep negatives for a period not less than six years.
Complaints: In the unlikely event of an unresolved complaint, the client may request the Master Photographer Association or The British Institute of Professional Photographers to act as independent conciliators, their recommendations will be accepted as final. In the event of a complaint, previews must be returned to he Studio within 7 working days. |
